Terms of Service

These Terms of Service ("Terms") govern your use of the Trace Performance application and related services (the "Service") operated by Kelsi Lakey, doing business as Trace Performance ("we," "us," "our"). By creating an account or using the Service, you agree to these Terms and our Privacy Policy.

1. Eligibility

• You must be at least 13 years old to create an account.
• If you are under 18, you represent that a parent or legal guardian has reviewed these Terms and agrees to them on your behalf.
• If we learn that an account belongs to a child under 13, we will terminate it.

2. The Service

Trace Performance lets sports teams record and upload athletic performance videos, organize them by athlete and team, receive AI-assisted athlete identification, manage rosters and member access, and optionally synchronize Freelap timing data.

3. Accounts

You agree to provide accurate registration information, keep your credentials confidential, and notify us of unauthorized use. You are responsible for activity under your account. We may suspend accounts that violate these Terms.

4. User Content

Your content stays yours. You retain ownership of videos, audio, and other content you upload ("User Content").

License to operate the Service. You grant us a non-exclusive, worldwide license to host, store, process, transcode, and display your User Content solely to provide the Service — including processing it with AI models for athlete identification and sharing it with members of your teams according to their access roles. We do not use your content to advertise and do not sell it.

Your representations. By uploading content, you represent and warrant that:

• You own it or have all necessary rights and permissions to upload it;
• For every person depicted — and specifically for every minor — you have obtained the consent of that person's parent or legal guardian to record, upload, store, and share the content within your team. This includes athletes on your roster, and it applies whether you are a coach, parent, or other account holder;
• The content does not violate any law or third-party right.

Enforcement. We may remove content that violates these Terms or law, including reports of minors depicted without consent.

5. Acceptable Use

You agree not to:

• Upload content depicting any minor without the consent described in Section 4, or any content that exploits or harms minors in any way;
• Upload unlawful, defamatory, or infringing content;
• Film or upload people without a lawful basis or required consent;
• Share your account, access another user's content without authorization, or circumvent access controls;
• Scrape, bulk-download, or reverse-engineer the Service, or use it to build a competing product;
• Interfere with the Service's operation or security.

6. Teams and Member Access

Team features operate on roles: owners manage the roster and content, collaborators can upload and manage, and members view content for athletes assigned to them. Team owners are responsible for who they invite and for ensuring member access respects the consent obtained from parents and guardians. When a team is deleted, its content is removed after a 30-day notice period.

7. AI-Assisted Features

Athlete identification and visual analysis are suggestions, not guarantees. The Service may misidentify athletes; review flagged results in the review queue. The Service is a recording and analysis tool — it is not coaching, medical, or safety advice, and is not a substitute for qualified instruction or supervision.

8. Third-Party Services

• Freelap: timing sync uses your own MyFreelap account. Your use of Freelap is governed by Freelap's own terms; we are not responsible for their service or data.
• The app is distributed via the Apple App Store and Google Play; their terms also apply to your download and use.

9. Fees

The Service is currently provided free of charge. We may introduce paid features in the future with advance notice; existing content and core access will not be removed without reasonable notice.

10. Termination

You may stop using the Service or delete your account at any time by contacting [email protected]. We may suspend or terminate access for violation of these Terms, unlawful content, or risk to other users — including immediately, where minors' safety is implicated.

11. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that athlete identification or timing data will be accurate or error-free.

12. Limitation of Liability

To the maximum extent permitted by law, Trace Performance will not be liable for indirect, incidental, consequential, or punitive damages, or for lost data, lost profits, or lost content, arising from your use of the Service. Our total liability for any claim will not exceed the greater of $100 or the amounts you paid us in the twelve months before the claim.

13. Indemnification

You agree to indemnify and hold harmless Trace Performance from claims, damages, and expenses arising out of your User Content, your violation of these Terms, or your failure to obtain required consents — including parental or guardian consent — for people depicted in content you upload.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in King County, Washington, and the parties consent to their jurisdiction.

15. Changes to These Terms

We may update these Terms. We will post the revised version with a new effective date and notify you of material changes. Continued use after changes take effect constitutes acceptance.

If any provision is found unenforceable, the remainder continues in effect. Our failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy, are the entire agreement between you and Trace Performance regarding the Service.
